terms and conditions
By booking a session and submitting payment, you (“Client”) agree to the following Terms & Conditions with Aleksandra Zaytseva (“Photographer”).
1. Booking & Services
The services to be provided (date, time, location, and session details) are as outlined in your proposal, confirmation email, or invoice.
The Photographer retains full artistic discretion and will deliver images consistent with her portfolio style.
2. Fees & Payment
A non-refundable retainer is required to secure your session date. The retainer is credited toward the total session fee.
The remaining balance is due by the date stated on your invoice. Sessions may not proceed and images will not be delivered until full payment is received.
Applicable VAT (IVA) will be added where required under Spanish law.
3. Rescheduling & Cancellations
Rescheduling requests must be made in writing at least 7 days before the session where possible. The retainer may be transferred once to a new date within 60 days, subject to availability.
Cancellations or failure to attend the session result in forfeiture of the retainer.
If the Photographer is unable to perform due to illness, emergency, or circumstances beyond reasonable control, liability is limited to rescheduling or refund of fees paid for services not rendered.
4. Client Responsibilities
The Client is responsible for:
- Arriving on time (late arrivals may result in a shortened session without refund).
- Obtaining any necessary permissions, permits, or location approvals.
- Ensuring appropriate conduct of all participants.
- Travel outside Barcelona may incur additional agreed expenses.
5. Image Delivery & Editing
Final edited images will be delivered via private online gallery or agreed method within the timeframe stated in your session information.
Standard professional editing is included. Additional retouching beyond standard edits may incur an additional fee. RAW/unprocessed files are not delivered.
6. Copyright & Usage
All images remain the intellectual property of the Photographer in accordance with Spanish copyright law (Real Decreto Legislativo 1/1996).
Upon full payment, the Client receives a non-exclusive, perpetual license to use the images for personal and commercial purposes, including branding, marketing, advertising, website, social media, print, and promotional materials.
Images may not be resold, sublicensed, or used as standalone stock imagery without written permission.
The Photographer may use selected images for portfolio, website, social media, competitions, publications, and promotional purposes unless the Client provides written notice requesting confidentiality prior to image delivery.
7. Limitation of Liability
The Photographer will perform services with reasonable care and professionalism but is not liable for indirect or consequential damages.
Maximum liability under these Terms shall not exceed the total amount paid by the Client.
8. Governing Law
These Terms are governed by the laws of Spain.
By confirming your booking and submitting payment, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
